LPA & Law FAQs
Plain-English answers to the most important questions about legal capacity, timing, and securing your future with Lasting Powers of Attorney.
What is a Lasting Power of Attorney?
An LPA is a legal document that lets you appoint 'attorneys' to make decisions for you if you cannot. There are two types: one for financial affairs and one for health.
When is the best time to set up an LPA?
The best time is now, while you have full mental capacity. You cannot wait for an accident or illness; once capacity is lost, the process becomes much more complex and costly.
Who is eligible to be an attorney?
Attorneys must be 18 or older and have mental capacity. Usually, clients choose trusted family members, close friends, or a professional like a solicitor.
What does 'mental capacity' mean?
It means being able to understand and weigh information to make a specific decision. We ensure the process is clear and supportive during our capacity assessments.
Can I change my attorneys later?
Yes, as long as you still have mental capacity, you can revoke an attorney or the entire LPA and create a new one to reflect your updated wishes.
How long does registration take?
The Office of the Public Guardian currently takes around 20 weeks to register LPAs. We manage the administration to ensure no avoidable delays occur.
Do I need both types of LPA?
While it is optional, we highly recommend both. Protecting your finances is vital, but ensuring your medical wishes are respected is equally important.
What happens if I don't have an LPA?
Without an LPA, your family must apply to the Court of Protection. This is significantly more expensive, time-consuming, and often distressing.
